BY DOWNLOADING OR USING THE APP, THESE TERMS WILL AUTOMATICALLY APPLY TO YOU – YOU SHOULD MAKE SURE THEREFORE THAT YOU READ THEM CAREFULLY BEFORE USING THE APP.

• GENERAL:MUSCAT DERMATOLOGY CENTRE reserves the right to update these Terms of Use from time to time, if it does so, the updated version will be effective immediately, and the current Terms are available through a link in the App to this page. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of the App. No other variation to these Terms shall be effective unless in writing and signed by an authorized representative on behalf of MUSCAT DERMATOLOGY CENTRE. This version of the Terms and conditions is effective as from 01 JUNE 2023
• ACCOUNT TERMS:

To access and use the Services, you must register for an account (“Account”) by providing your full legal name, current address, phone number, a valid email address, and any other information indicated as required. We may reject your application for an Account, or cancel an existing Account, for any reason, in our sole discretion.
   2. You acknowledge that , this application will use the Phone Numbers you provide as the primary method for communication.
   3. You are responsible for keeping your password secure. MUSCAT DERMATOLOGY CENTRE cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password.

• GENERAL RULES RELATING TO CONDUCT: The App is made available for your own, personal use. The App must not be used for any commercial purpose whatsoever or for any illegal or unauthorized purpose. When you use the application you must comply with all applicable international laws, including the local laws in your country of residence (together referred to as “Applicable Laws”).
• You agree that when using the App you will comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to:

1. 1. Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement; or
   2. Attempt to gain unauthorized access to the App or any networks, servers or computer systems connected to the App; or
   3. Modify, adapt, translate or reverse engineer any part of the App or reformat or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by law.
   4. Knowingly introducing viruses or other malicious or harmful material or using it in connection with unsolicited communications.

• You agree to indemnify MUSCAT DERMATOLOGY CENTRE and its group companies in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws.
• OUR RESPONSIBILITIES TO YOU: While we will endeavor to ensure that the App is normally available 24 hours a day, we shall not be liable if for any reason the App is not available at any time or for any period. Access to the App may be suspended temporarily from time to time and without notice in the case of system failure, maintenance or repair or for any reason beyond our control or if we deem it necessary. For the avoidance of doubt, we shall not be liable for any loss or liability which may be suffered or incurred by you as a result of any suspension of, or interruption to, the operation of the App.
• We do not accept any responsibility to you for:

1. 1. Malfunctions in communications facilities which cannot reasonably be considered to be under our control and that may affect the accuracy or timeliness of messages you send or the material you access via the App;
   2. any losses or delays in transmission of messages or material you access arising out of the use of any Internet access service provider or mobile network service provider or caused by any browser or other software which is not under our control;
   3. Viruses that may infect your computer equipment or other property on account of your access to or use of the App or your any accessing materials on the App.
   4. Any unauthorized use or interception of any message or information before it reaches the App or our servers from the App;
   5. Any unauthorized use of or access to data relating to you or your transactions which is held by us (unless such use or access is caused by our negligence, fraud or failure to comply with laws relating to the protection of your data), to the extent permitted by local law;
   6. Any content provided by third parties.

• INTELLECTUAL PROPERTY RIGHTS: The copyright in all material contained on, in, or available through the App including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (“Material“) is owned by or licensed to company or its group companies. All rights are reserved. You can view, print or download extracts of the Material for your own personal use but you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without MUSCAT DERMATOLOGY CENTRE express permission.
• The trademarks, service marks, and logos (“Trademarks“) contained on or in the App are owned by MUSCAT DERMATOLOGY CENTRE or its group companies or third party partners of MUSCAT DERMATOLOGY CENTRE you cannot use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of MUSCAT DERMATOLOGY CENTRE or the relevant group company or the relevant third party partner of MUSCAT DERMATOLOGY CENTRE.
• COLLECTION OF PERSONAL DATA: The personal information we may collect through these various sources may include, but is not limited to:

   2. Email addresses,
   3. Nationality and Country of residence,
   4. ID Card details,
   5. Date of Birth,
   6. Gender

• ADVERTISERS IN THE APP: We accept no responsibility for adverts contained within the App. If you agree to purchase goods and/or services from any third party who advertises in the App, you do so at your own risk. The advertiser, is responsible for such goods and/or services and if you have any queries or complaints in relation to them, your only recourse is against the advertiser.

• TERMINATION AND SUSPENSION: We may terminate or suspend your use of the App with or without notice at any time and without any liability to you. Upon any termination your right to use the App, and any other rights or permissions granted to you in these App T&Cs, will end and you must stop using the App and delete it from your Device.
• LAW AND JURISDICTION: These App T&Cs and any dispute or claim arising out of or in connection with them or their subject matter (including any non-contractual disputes or claims) will be governed by the law of Austria and the parties agree that the courts of Vienna, Austria will have exclusive jurisdiction to settle any such disputes or claims.

    MUSCAT DERMATOLOGY CENTRE exercises due diligence to ensure the confidentiality of the Client Data, within its legal obligations. MUSCAT DERMATOLOGY CENTRE is not liable for any damages to the confidentiality of Client Data, through illegal practices of third parties that involve actions on devices used by Clients, or due to any virus attacks, or vulnerability of client data stored in Server Database.
